Court of Appeal: Sleep-in Decision

• The Court of Appeal has allowed our client Royal Mencap Society’s appeal.

• The decision is of enormous impact for the care sector; the claim had threatened some providers’ future viability because of a gap in funding estimated in the hundreds of millions of pounds.

• The Court of Appeal held that a care worker was not entitled to be paid the NMW for all the time that she was on a ‘sleep-in’ shift.
