In this edition:

• The EAT hold that an ET’s decision that dismissal was fair could not stand as the ET had not properly addressed the Claimant’s argument that another employee had been treated more leniently for like misconduct.
• Research of 501 bosses of SMEs, carried out by law firm Slater and Gordon, reveals that one in three bosses admit they have or would reject a female job applicant because they suspect she ‘might start a family soon’.
• An ET has decided in a preliminary hearing that an ex-Ministry of Defence employee’s belief in Scottish independence qualifies as a protected philosophical belief under S.10(2) of the Equality Act 2010.
• Figures released by the Office for National Statistics show that employees took an average of 4.1 days off sick in 2017 – almost half the 7.2 days taken in 1993, when records began.
